Backtracks4all.com (herein after – the Site or Website) is a platform where you can download and use professional custom backing tracks. These Terms and Conditions ("Terms") outline the rules and regulations for your use of our website and services provided by Stemfonia LTD ("we," "us," or "our"). Please read these Terms carefully before engaging with our website.
1. Acceptance of Terms
By accessing or using backtracks4all.com, you automatically agree with our Terms and all applicable laws and regulations that are governed by United Kingdom. If you disagree with any part of these Terms, please do not enter or use our Site or any materials from our Site.
2. Materials reproduced
All recordings on our Website library are not the originals. These are re-recorded versions of the original songs. These recordings do not use original music, original vocals, samples, or any feature of the original audio recordings. The names of the original artists are given for reference only. To abide by the intellectual and property rights, you must obtain the necessary authorizations from the rights holders (collective rights management and/or music publishers). All sound recordings on this site are produced and licensed by Stemfonia LTD, and all musical material is fully re-recorded in our music production & recording studio. We do not use any feature of the original recordings, unless this has been expressly agreed with the copyright holder (usually when we have produced the original recordings ourselves).
3. User Eligibility
You must be at least 18 years old to use our services. By using our website, you represent and warrant that you are of legal age and have the necessary consent to enter into these Terms.
3.1 User allowance:
By using our website or services we give the user the permission to use our backing tracks:
- for online monetization on personal social media sites and video platforms such as Vimeo, Facebook, YouTube, Instagram, Tik-Tok etc.;
- for distribution either in the form of physical units (maximum 1000 copies), digital downloads or digital streams (maximum 500 000 streams or downloads) on platforms such as Spotify, Itunes, Deezer, own website etc.;
- for private performance or local and national promotions (public/live performances, radio and TV)
If you intended to use our website and services (e.g. backing tracks) you need to request the permission from the following publishers: PRS, MCPS, Sacem, PRS, BMI or ASCAP.
3.2. User restrictions
By using our website or services we don’t allow the user to use our backing tracks:
- in any audiovisual work other than the Work;
- in any advertisement;
- in any Work made for Hire or use by another party (sub-licensing) that makes or generates compensation from use of the Licensed Tracks or the Work that includes the Tracks.(WHEN APPLICABLE)
- in broadcast, cable, or web television, video games, mobile applications or radio rather than with the exception of paragraph 2.2
- to physically perform or lip-synch the lyrics of the music of the Track, or in anyway use the artist's image or likeness except for the purposes of providing artist credit;
4. User Accounts
To access certain features of backtracks4all.com, you may need to register an account. You are responsible not to share the confidential information of your account and agree to accept responsibility for all activities that might occur under your account. Multiple accounts are strictly prohibited; it may cause temporary service suspension or permanent ban.
5. Fair Use Clause
You agree to use our services in accordance with applicable laws and regulations that are governed by United Kingdom. We grant you a limited, non-exclusive, non-transferable right to access and use our platform for personal and non-commercial purposes. Any unauthorized use of our services, including but not limited to scraping, data mining, or reverse engineering, is strictly prohibited.
6. Intellectual Property Rights
The content and materials available on backtracks4all.com, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, are the property of Stemfonia LTD or its licensors. You must not use, copy, distribute, modify, or reproduce any copyrighted materials without our prior written consent.
7. Indemnification
You agree to indemnify, defend, and hold Stemfonia LTD and its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of our website, services or violation of these Terms.
8. Limitation of Liability
Under no circumstances shall Stemfonia LTD be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of our website and services. You use our website and services at your own risk.

We reserve the right to modify, suspend, or terminate any aspect of our website or services at any time without notice. We may also update these Terms from time to time.
